Texas Education Code, Section 25


 25.0341. TRANSFER OF VICTIMS OF BULLYING.                                

Text of section as added by Acts 2005, 79th Leg., ch. 920, § 2

(a)  In this section, "bullying" means engaging in written or
verbal expression or physical conduct that a school district board
of trustees or the board's designee determines:
(1)  will have the effect of physically harming a
student, damaging a student's property, or placing a student in
reasonable fear of harm to the student's person or of damage to the
student's property;  or
(2)  is sufficiently severe, persistent, or pervasive
enough that the action or threat creates an intimidating,
threatening, or abusive educational environment for a student.
(b)  On the request of a parent or other person with
authority to act on behalf of a student who is a victim of bullying,
the board of trustees of a school district or the board's designee
shall transfer the victim to:
(1)  another classroom at the campus to which the
victim was assigned at the time the bullying occurred;  or
(2)  a campus in the school district other than the
campus to which the victim was assigned at the time the bullying
occurred.
(c)  The board of trustees or the board's designee shall
verify that a student has been a victim of bullying before
transferring the student under this section.
(d)  The board of trustees or the board's designee may
consider past student behavior when identifying a bully.
(e)  The determination by the board of trustees or the
board's designee is final and may not be appealed.
(f)  A school district is not required to provide
transportation to a student who transfers to another campus under
Subsection (b)(2).
(g)  Section 25.034 does not apply to a transfer under this
section.        


If the system won't help you, then read up on your childs rights. And complain, file with the TEA (Texas Education Agency). Parents must take a stand.

THESE PROBLEMS ARE IN MOST SCHOOLS TODAY, UNTIL PARENTS, TEACHERS, ADMINISTRATORS, AND ANYONE ELSE TAKE RESPONSIBILITY---THINGS ARE GONNA GET WORSE.  THAT IS WHY WE HOMESCHOOL!!!!!!!biggrin

Good for you,,,if all parents would band together,and threaten to pull there kids out,until something is done for the child,then it would happen.
 Get the superintent involved...insist the parents of the child get help,,,yes there is a problem somewhere in his home or family,he has seen or watched to much violence? Read my post on the other  site about bullying,about what happened to my daughter in school,and I failed to say that this happened at
the almighty PNG high school,where no one is concerned about anything but attendance and tax tests.
 When I took my daughter for drug counceling in port arthur,the councelor told me he had scores of kids from the PNGISD. The principle at that time told our
PTA that we didn't have a drug problem. I stated that he was burying his head
in the sand,and I never went back. I guess he didn't know,and what still goes on the
scores of drug parties without parents that goe on EVERY week-end...know where your child is. If she says she's spending the nite at susies' make sure follow up...follow her...listen in on phone conversations...that's the only way your gonna know for sure. And don't worry about ruining her reputation,like I did,worry about her running her life...DON'T TRUST YOUR KID!!

Wow... I can't believe that this kind of behavior can be allowed to happen once or twice, much less continue repeatedly in a PUBLIC SCHOOL. It sounds like this kid needs one of three things: removal from the class, serious psychoactive drugs, or best of all, a good old-fashioned trip to the woodshed.

I very strongly agree with the person who wrote this I can not believe that the little child who stabbed someone in the eye has not been expelled. I think that all appropriate measures should be taken so that the kids in our elementary schools can feel safe to go to school. School is a place of learning not a place where children should be scared to go to school. School is also not a place that someone should be able to find the next person they are going to pick on. What happens next? If something is not done about this this child will think that he did nothing wrong. He needs to be expelled or even sent to a different school. With the very short attention spans that 5 year olds have how can you expect them to learn anything if they have to witness things like this in their classrooms. It is a shame that some kids have to go through this. Some parents try very hard to filter out the bad in childrens life. By monitoring what their children watch on tv, the websites they get on on the internet, and the things they see outside in the world. But who in their right minds should have to worry about their children going to kindergaten. What happen to the innocence of children it has changed over the years and I think it is time for the parents and the school to step up and take control of this situation.

confusedThis is outrageous that a child that does these kind of things is allowed to stay in school with no punishment but a slap on the hand. He has physically harmed a child and nothing is done. What has to happen before teachers understand little things can turn in to big problems? Do childen have to come in and kill 33 people before someone recognizes and jumps in to try to resolve the issue before it gets any bigger? Then everyone will sit around saying we should have done something. Well here is the chance to help this kid understand that how he is treating these children is not right. If one of the children this child is picking on decides to defend himself/herself will be punished or is it just going to be looked over as this issue has been. These innocent children are being tormented everyday in a place they should feel safe.  I agree that this is not the childs fault, but something needs to be done before this turns into something bigger.

My child is a kindergarten student at Dick Dowling Elementary in Port Acres, Texas.  I have, what I and other parents, consider to be very valid concerns.  A child in the class has pinched my son hard enough to leave a bruise for 6 days.  He has pushed a child down and laughed when he cried.  He has stood in front of the bathroom door when several of his classmates were inside and turned off the lights on them, blocking them inside in the dark.  He has kicked, hit, tripped, teased, insulted and scared his classmates, on numerous occassions.  He consistently verbally abuses my son and his friend for being friends when "they aren't the same color and are not supposed to be friends".  And yet NOTHING is being done.  The "last straw" occurred last week when he poked a sharpened pencil into a classmate's eye!!!

At that point, I had enough.  I went to the principal demanding that the child be removed from the class, for my son's safety, as well as the safety of the other students.  The principal, although extremely nice and compassionate, basically said this child has rights and his hands were tied.  He recieved some ridiculous "punishment" and is back in the same class, doing the same thing.  He did offer to remove MY child from the class, as if that is a fair thing to do to my son.  He, and the other students, love the teacher.  Why should my son be punished for the action's of this juvenile-delinquent-in-training???

I do consider myself to be a fair woman.  I am intelligent and educated and not prone to "fly off the handle".  But this is going beyond a normal situation.  I am fully aware that this child is not guilty here.  In reality, a 5 year-old child is simply a sponge, absorbing what he sees in his world.  Maybe it is at home, maybe TV, maybe older siblings or friends.  However, I DO NOT CARE.  This baby obviously needs some help, counseling, something.  I do not plan to have my only child in that class while this kid gets straightened out.

Why is it that he is allowed to continue this same madness?  A little girl (also in the same class!) brought her Daddy's pocketknife to school to show her friends "because she thought it was pretty" and she was suspended on the spot!  She couldn't even open the knife blade if she tried.  She had it in her backpack and the entire school flipped out.  She is an innocent and was treated this way over a rule she did not understand.  Yet, this kid regularly ASSAULTS AND INTIMIDATES his classmates and nothing happens?!  He stabs a child in the eye with a sharp pencil and nothing?

What has happened to our schools?  Why is this allowed to go on?  Where is the ownership and responsibility for the saftey of my child and the hundred others at this school?  At the moment, I am torn between picking up my entire life and moving out of Port Acres or absorbing the cost of private school.  But, mark my words, come hell or high water, I absolutely REFUSE to allow my child to be educated in the PAISD.
